Terms of Service

These terms ("Terms") govern your access to and use of the Moodwall application ("Moodwall" or the "App") and the website at moodwall.app (the "Site"), both operated by Trinta ("we", "us", "our"). By installing, accessing, or using Moodwall, you agree to these Terms. If you don't agree, please don't use it.

1. The license you get

When you purchase Moodwall, we grant you a personal, non-exclusive, non-transferable, perpetual license to install and use the App on Macs that you own or control. This license is for personal or business use within your own organization. You may not:

• Resell, sublicense, rent, lease, or distribute the App
• Reverse-engineer, decompile, or disassemble the App, except to the extent applicable law expressly permits
• Remove or modify any proprietary notices or labels
• Use the App in violation of applicable law or third-party rights

Updates and bug fixes for the same major version are included for free under the same license.

2. Pinterest content

Moodwall fetches images from public Pinterest boards via Pinterest's public widget endpoints, on your behalf, for personal display on your own Mac. You're responsible for:

• Only configuring boards that you own, have permission to use, or that are publicly available
• Complying with Pinterest's own Terms of Service
• Respecting the copyright of the original creators of any pins displayed

Moodwall does not host, store, or redistribute Pinterest content beyond the local cache on your own Mac required to render your wallpaper.

3. Payments and refunds

Direct purchases on this Site are processed by Stripe or Paddle. Mac App Store purchases are handled exclusively by Apple under their standard terms.

We offer a 30-day money-back guarantee for direct purchases. If you're not happy with Moodwall, email us within 30 days of purchase for a full refund. App Store purchases are governed by Apple's refund policy.

4. Acceptable use

You agree not to:

• Use Moodwall to display content that is unlawful, infringing, or harmful
• Attempt to disrupt, attack, or probe the Site or its infrastructure
• Use the App in any way that interferes with Pinterest's services

5. Intellectual property

The Moodwall name, logo, source code, design, and documentation are owned by Trinta and protected by copyright and trademark law. These Terms grant you a license to use the App, not ownership of it.

6. Disclaimers

Moodwall is provided "as is" and "as available", without warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that Moodwall will be uninterrupted, error-free, or that any specific Pinterest board will remain accessible (Pinterest controls that, not us).

7. Limitation of liability

To the maximum extent permitted by law, Trinta will not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or related to your use of Moodwall. Our total liability for any claim arising from or related to these Terms or Moodwall will not exceed the amount you paid us for the App in the twelve months preceding the claim.

Some jurisdictions don't allow exclusions or limits like these. In those jurisdictions, the limits apply only to the maximum extent permitted.

8. Termination

Your license terminates automatically if you breach these Terms. You may also stop using Moodwall at any time by uninstalling it. Sections that by their nature should survive termination (e.g. ownership, disclaimers, liability) will survive.

9. Changes

We may update these Terms from time to time. The "last updated" date at the top of this page reflects the latest version. Material changes will be communicated reasonably in advance.

10. Governing law

These Terms are governed by the laws of Portugal, without regard to its conflict-of-laws rules. Any dispute will be resolved in the competent courts of Lisbon, Portugal, except where applicable law gives you the right to bring claims in your local jurisdiction.
